These Terms of Service govern use of the GM Fragrance House online store and retail purchases made through it. GM Fragrance House is operated by GABMORA LLC, a Florida limited liability company. By accessing the store or placing an order, you agree to these Terms together with our Privacy Policy, Shipping Policy, Returns & Refunds Policy, and any additional terms clearly disclosed before purchase.
Eligibility and lawful use
You may use this store only for lawful purposes. You must be legally capable of entering into a binding transaction or use the store with the involvement of a parent or legal guardian where required. You are responsible for providing accurate billing, shipping, contact, and payment information.
Products and product information
We make reasonable efforts to present product identity, brand, size, concentration, description, photographs, and pricing accurately. Manufacturers can change packaging, bottle details, labels, batch presentation, color, or formulation from time to time. Screen settings, photography, and packaging revisions can also affect appearance. Such manufacturer or photographic differences do not automatically mean that an item is defective or different from the product ordered.
If a product received is materially different from the item ordered or materially misdescribed, contact us so the issue can be reviewed under our Returns & Refunds Policy and applicable law.
Third-party brands and trademarks
GM Fragrance House is an independent retailer and reseller unless a specific brand relationship is expressly stated otherwise. Third-party brand names, product names, trademarks, trade dress, and logos belong to their respective owners and are used to identify and describe merchandise offered for resale. Their appearance on this store does not by itself imply sponsorship, affiliation, endorsement, or authorization by the trademark owner.
Orders and acceptance
Submitting an order is an offer to purchase. An automated order confirmation acknowledges that we received the order but does not necessarily constitute final acceptance or shipment. We may reasonably decline, limit, hold for verification, or cancel an order because of product unavailability, shipping restrictions, suspected fraud or unauthorized payment, pricing or listing errors, duplicate orders, legal or regulatory requirements, or other legitimate operational reasons.
If we cancel an order after collecting payment, we will refund the applicable amount in accordance with applicable law. We do not reserve the right to retain payment for merchandise we determine we cannot fulfill.
Pricing, taxes, and errors
Prices may change before an order is placed. Applicable taxes, shipping charges, duties, and other charges are displayed or calculated at checkout when available. If a material pricing, product, or technical error is discovered after an order is submitted, we may contact you for instructions or cancel and refund the affected transaction to the extent permitted by law.
Payments and fraud prevention
You represent that you are authorized to use the payment method submitted. Payments may be processed by Shopify Payments or other payment-service providers. We may use reasonable fraud-prevention and identity or address-verification measures before fulfillment. Nothing in these Terms restricts lawful payment-dispute, chargeback, or consumer-protection rights.
Shipping, cancellations, returns, and refunds
Our Shipping Policy and Returns & Refunds Policy are incorporated into these Terms. Shipping dates are subject to the requirements described in the Shipping Policy. Return eligibility, damaged or incorrect orders, cancellations, and refunds are governed by the Returns & Refunds Policy and any non-waivable rights under applicable law.
Fragrance safety
Fragrance products may contain alcohol, fragrance compounds, allergens, or other ingredients that can cause irritation or sensitivity in some individuals and may be flammable. Follow the manufacturer's label, ingredient information, warnings, and directions. Keep fragrance away from flames, excessive heat, eyes, and uses not intended by the manufacturer. Discontinue use if irritation occurs and seek appropriate medical advice when needed. Information on this store is provided for product-selection purposes and is not medical advice.
Intellectual property
The GM Fragrance House name, original store design, original written content, graphics, and other content created by or for GABMORA LLC are owned by or licensed to GABMORA LLC and may not be copied, reproduced, distributed, or commercially exploited without permission except as permitted by law. Third-party intellectual property remains the property of its respective owners.
Reviews and customer content
Customers are free to express honest opinions about products, service, and their experience. Nothing in these Terms prohibits or penalizes a lawful, honest consumer review. Content submitted to the store must not be fraudulent, knowingly false, unlawful, threatening, defamatory in a manner not protected by law, infringing, malicious, or contain malware or another person's confidential personal information.
If you voluntarily submit content for publication on our store, you grant GABMORA LLC a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and format that content for operation and promotion of the store, subject to applicable law. This license does not require you to surrender ownership of your review or other content.
Prohibited conduct
You may not use the store to commit fraud or unlawful activity; interfere with security or normal operation; introduce malicious code; impersonate another person; submit unauthorized payment information; infringe intellectual-property or privacy rights; or scrape, automate, or access the store in a manner that materially disrupts service or circumvents security controls.
Third-party services and links
The store may use or link to third-party services including Shopify, payment processors, carriers, analytics providers, social platforms, and other service providers. Those services can be governed by their own terms and privacy practices. We are not responsible for third-party websites or services we do not control, except to the extent applicable law provides otherwise.
Disclaimers
To the fullest extent permitted by law, the store and its content are provided without warranties beyond those expressly stated or legally required. We do not exclude or disclaim warranties, consumer rights, remedies, or liabilities that applicable law does not permit to be excluded.
Limitation of liability
To the fullest extent permitted by applicable law, GABMORA LLC and GM Fragrance House will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from use of the store or a retail transaction. Where applicable law permits a monetary limitation, our aggregate liability arising from a specific retail order will not exceed the amount actually paid to us for the affected order. These limitations do not apply to liability that cannot lawfully be limited, including where a jurisdiction prohibits limitation for particular misconduct, injury, or statutory rights.
Indemnification
To the extent permitted by law, you agree to indemnify and hold GABMORA LLC harmless from third-party claims, losses, or reasonable expenses arising directly from your unlawful misuse of the store, infringement of another person's rights, or material breach of these Terms. This provision does not shift responsibility to a consumer for conduct attributable to GABMORA LLC or rights that cannot lawfully be waived.
Wholesale and business-to-business transactions
Unless expressly stated otherwise, these Terms are written for retail online purchases. Wholesale, distributor, reseller, or other business-to-business transactions may be governed by a separate written quotation, invoice, purchase order, wholesale policy, or agreement. If a separately agreed written B2B term conflicts with these retail Terms, the separately agreed B2B term controls for that transaction to the extent permitted by law.
Governing law and disputes
These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles, except where mandatory consumer-protection law requires another result. To the extent a venue provision is legally enforceable, disputes relating to these Terms or a retail transaction may be brought in a court of competent jurisdiction serving Miami-Dade County, Florida. Nothing in this provision deprives a consumer of a forum or remedy that applicable law requires to remain available.
Severability and waiver
If a provision of these Terms is found unenforceable, it will be limited or severed only to the extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision on one occasion does not waive the right to enforce it later.
Changes
We may update these Terms prospectively. The version presented or made available in connection with a transaction governs that transaction, subject to applicable law. Material changes do not retroactively eliminate rights already accrued.
